Information literacy


Several conceptions and definitions of information literacy have become prevalent. For example, one conception defines information literacy in terms of a set of competencies that an informed citizen of an information society ought to possess to participate intelligently and actively in that society (from [1]).
The American Library Association's (ALA) Presidential Committee on Information Literacy, Final Report states, "To be information literate, a person must be able to recognize when information is needed and have the ability to locate, evaluate, and use effectively the needed information" (1989).
Jeremy Shapiro & Shelley Hughes (1996) define information literacy as "A new liberal art that extends from knowing how to use computers and access information to critical reflection on the nature of information itself, its technical infrastructure and its social, cultural, and philosophical context and impact." (from [2])
Information literacy is becoming a more important part of K-12 education. It is also a vital part of university-level education (Association of College Research Libraries, 2007). In our information-centric world, students must develop skills early on so they are prepared for post-secondary opportunities, whether in the workplace or in pursuit of higher education.

A seminal event in the development of the concept of information literacy was the establishment of the American Library Association's Presidential Committee on Information Literacy, whose final report outlined the importance of the concept. The concept of information literacy built upon and expanded the decades-long efforts of librarians to help their users learn about and how to utilize research tools (e.g., periodical indexes) and materials in their own libraries. Librarians wanted users to be able to transfer and apply this knowledge to new environments and to research tools that were new to them. Information literacy expands this effort beyond libraries and librarians, and focuses on the learner, rather than the teacher (Grassian, 2004; Grassian and Kaplowitz, 2001, pp.14-20).
Other important events include:
1974: The related term ‘Information Skills’ was first introduced in 1974 by Zurkowski to refer to people who are able to solve their information problems by using relevant information sources and applying relevant technology (Zurkowski, 1974).
1983: A Nation at Risk: The Imperative for Education Reform
shows that we are "raising a new generation of Americans that is scientifically and technologically illiterate."
1986: Educating Students to Think: The Role of the School Library Media Program
outlines the roles of the library and the information resources in K-12 education
1987: Information Skills for an Information Society: A Review of Research
includes library skills and computer skills in the definition of information literacy
1988: Information Power: Guidelines for School Library Media Programs
1989: National Forum on Information Literacy (NFIL), a coalition of more than 90 national and international organizations, has its first meeting

Tool literacy, or the ability to understand and use the practical and conceptual tools of current information technology relevant to education and the areas of work and professional life that the individual expects to inhabit.
Resource literacy, or the ability to understand the form, format, location and access methods of information resources, especially daily expanding networked information resources.
Social-structural literacy, or understanding how information is socially situated and produced.
Research literacy, or the ability to understand and use the IT-based tools relevant to the work of today's researcher and scholar.
Publishing literacy, or the ability to format and publish research and ideas electronically, in textual and multimedia forms (including via World Wide Web, electronic mail and distribution lists, and CD-ROMs).
Emerging technology literacy, or the ability to continuously adapt to, understand, evaluate and make use of the continually emerging innovations in information technology so as not to be a prisoner of prior tools and resources, and to make intelligent decisions about the adoption of new ones.
Critical literacy, or the ability to evaluate critically the intellectual, human and social strengths and weaknesses, potentials and limits, benefits and costs of information technologies. Ira Shor defines critical literacy as
habits of thought, reading, writing, and speaking which go beneath surface meaning, first impressions, dominant myths, official pronouncements, traditional clichés, received wisdom, and mere opinions, to understand the deep meaning, root causes, social context, ideology, and personal consequences of any action, event, object, process, organization, experience, text, subject matter, policy, mass media, or discourse.[3]

BACKGROUND
In 1983, the seminal report “A Nation at Risk: The Imperative for Educational Reform” declared that a “rising tide of mediocrity” was eroding the very foundations of the American educational system. It was, in fact, the genesis of the current educational reform movement within the United States. Ironically, the report did not include in its set of reform recommendations the academic and/or the public library as one of the key architects in the redesign of our K-16 educational system.
This report and several others that followed, in conjunction with the rapid emergence of the information society, led the American Library Association (ALA) to convene a blue ribbon panel of national educators and librarians in 1987. The ALA Presidential Committee on Information Literacy was charged with the following tasks:
(1) to define information literacy within the higher literacies and its importance to student performance, lifelong learning, and active citizenship; (2) to design one or more models for information literacy development appropriate to formal and informal learning environments throughout people's lifetimes; and (3) to determine implications for the continuing education and development of teachers.
In the release of its Final Report in 1989, the American Library Association Presidential Committee on Information Literacy summarized in its opening paragraphs the ultimate mission of the National Forum on Information Literacy:
“How our country deals with the realities of the Information Age will have enormous impact on our democratic way of life and on our nation's ability to complete internationally. Within America's information society, there also exists the potential of addressing many long-standing social and economic inequities. To reap such benefits, people--as individuals and as a nation--must be information literate. To be information literate, a person must be able to recognize when information is needed and have the ability to locate, evaluate, and use effectively the needed information. Producing such a citizenry will require that schools and colleges appreciate and integrate the concept of information literacy into their learning programs and that they play a leadership role in equipping individuals and institutions to take advantage of the opportunities inherent within the information society. Ultimately, information literate people are those who have learned how to learn. They know how to learn because they know how knowledge is organized, how to find information, and how to use information in such a way that others can learn from them. They are people prepared for lifelong learning, because they can always find the information needed for any task or decision at hand."
Acknowledging that the major obstacle to people becoming information literate citizens, who are prepared for lifelong learning, "is a lack of public awareness of the problems created by information illiteracy," the report recommended the formation of a coalition of national organizations to promote information literacy.”
Thus, in 1989, the A.L.A. Presidential Committee established the National Forum on Information Literacy, a volunteer network of organizations committed to raising public awareness on the importance of information literacy to individuals, to our diverse communities, to the our economy, and to engaged citizenship participation.
THE FORUM TODAY
Since 1989, the National Forum on Information Literacy has evolved steadily under the leadership of its first chair, Dr. Patricia Senn Breivik. Today, the Forum represents over 90 national and international organizations, all dedicated to mainstreaming the philosophy of information literacy across national and international landscapes, throughout every educational, domestic, and workplace venue.
Although the initial intent of the Forum was to raise public awareness and support on a national level, over the last several years, the National Forum on Information Literacy has made significant strides internationally in promoting the importance of integrating information literacy concepts and skills throughout all educational, governmental, and workforce development programs. For example, the National Forum co-sponsored with UNESCO and IFLA several “experts meetings”, resulting in the Prague Declaration (2003) and the Alexandria Proclamation (2005) each underscoring the importance of information literacy as a basic fundamental human right and lifelong learning skill.
In the United States, however, information literacy skill development has been the exception and not the rule, particularly as it relates to the integration of information literacy practices within of our educational and workforce development infrastructures. In October, 2006, the first national Summit on Information Literacy brought together well over 100 representatives from education, business, and government to address America’s information literacy deficits as a nation currently competing in a global marketplace. This successful collaboration was sponsored by the National Forum on Information Literacy, Committee for Economic Development, Educational Testing Service, the Institute for a Competitive Workforce, and National Education Association (NEA). The Summit was held at NEA headquarters in Washington, D.C.
A major outcome of the Summit was the establishment of a national ICT literacy policy council to provide leadership in creating national standards for ICT literacy in the United States.
In the final analysis, the National Forum on Information Literacy will continue to work closely with educational, business, and non-profit organizations in the U.S. to promote information literacy skill development at every opportunity, particularly in light of the ever growing social, economic, and political urgency of globalization, prompting us to re-energize our promotional and collaborative efforts here at home.

The first step in the Information Literacy strategy is to clarify and understand the requirements of the problem or task for which information is sought. Basic questions asked at this stage:
What is known about the topic?
What information is needed?
Where can the information be found?
Locating: The second step is to identify sources of information and to find those resources. Depending upon the task, sources that will be helpful may vary. Sources may include books, encyclopedias, maps, almanacs, etc. Sources may be in electronic, print, social bookmarking tools, or other formats.
Selecting/analyzing: Step three involves examining the resources that were found. The information must be determined to be useful or not useful in solving the problem. The useful resources are selected and the inappropriate resources are rejected.
Organizing/synthesizing: It is in the fourth step this information which has been selected is organized and processed so that knowledge and solutions are developed. Examples of basic steps in this stage are:
Discriminating between fact and opinion
Basing comparisons on similar characteristics
Noticing various interpretations of data
Finding more information if needed
Organizing ideas and information logically
Creating/presenting: In step five the information or solution is presented to the appropriate audience in an appropriate format. A paper is written. A presentation is made. Drawings, illustrations, and graphs are presented.
Evaluating: The final step in the Information Literacy strategy involves the critical evaluation of the completion of the task or the new understanding of the concept. Was the problem solved? Was new knowledge found? What could have been done differently? What was done well?

[edit] Another conception of information literacy
This conception, used primarily in the library and information studies field, and rooted in the concepts of library instruction and bibliographic instruction, is the ability "to recognize when information is needed and have the ability to locate, evaluate and use effectively the needed information" (Presidential Committee on Information Literacy. 1989, p. 1). In this view, information literacy is the basis for life-long learning, and an information literate person is one who:
Recognizes that accurate and complete information is the basis for intelligent decision making.
Recognizes the need for information.
Knows how to locate needed information.
Formulates questions based on information needs.
Identifies potential sources of information.
Develops successful search strategies.
Accesses sources of information including computer-based and other technologies.
Evaluates information no matter what the source.
Organizes information for practical application.
Integrates new information into an existing body of knowledge.
Uses information in critical thinking and problem solving. (Doyle, 1992)
Uses information ethically and legally.
Since information may be presented in a number of formats, the term "information" applies to more than just the printed word. Other literacies such as visual, media, computer, network, and basic literacies are implicit in information literacy.

[edit] Evolution of the economy
The change from an economy based on labor and capital to one based on information requires information literate workers who will know how to interpret information.
Barner's (1996) study of the new workplace indicates significant changes will take place in the future:
The work force will become more decentralized
The work force will become more diverse
The economy will become more global
The use of temporary workers will increase
These changes will require that workers possess information literacy skills. The SCANS (1991) report identifies the skills necessary for the workplace of the future. Rather than report to a hierarchical management structure, workers of the future will be required to actively participate in the management of the company and contribute to its success. To survive in this information society, workers will need to possess skills beyond those of reading, writing and arithmetic.

[edit] Standards
With the passage of the Goals 2000: Educate America Act (1994), subject matter organizations were able to obtain funding to develop standards in their respective subject areas. Information literacy skills are implicit in the National Education Goals and national content standards documents.
Three of the eight National Education Goals demonstrate the critical nature of information literacy to an information society:
Goal 1: School Readiness
Goal 3: Student Achievement and Citizenship
Goal 6: Adult Literacy and Lifelong Learning
An analysis of national content standards documents reveals that they all focus on lifelong learning, the ability to think critically, and on the use of new and existing information for problem solving. In K-12 education, national standards of the American Association of School Librarians that reference information literacy and are inclusive of national content standards include:
The student will access information efficiently and effectively.
The student will evaluate information critically and competently.
The student will use information accurately and creatively.
Individual states are creating initiatives to ensure that students attain information literacy skills by the time they graduate from high school. Kentucky (1995), Utah (1996), and California (1994) are but three examples of states that have publications depicting these initiatives.
National content standards, state standards, and information literacy skills terminology may vary, but all have common components relating to information literacy.
In 2000, the Association of College and Research Libraries (ACRL), a division of the American Library Association (ALA), released the Information Literacy Competency Standards for Higher Education http://www.ala.org/ala/acrl/acrlstandards/informationliteracycompetency.cfm. There are five standards which are directly linked to a host of performance indicators. These standards and performance indicators are often considered the best practices against which institutions of higher education can implement and assess information literacy programs. The standards are:
Standard One: The information literate student determines the nature and extent of the information needed.
Standard Two: The information literate student accesses needed information effectively and efficiently.
Standard Three: The information literate student evaluates information and its sources critically and incorporates selected information into his or her knowledge base and value system.
Standard Four: The information literate student, individually or as a member of a group, uses information effectively to accomplish a specific purpose.
Standard Five: The information literate student understands many of the economic, legal, and social issues surrounding the use of information and accesses and uses information ethically and legally.
These standards are meant to span from the simple to more complicated, or in terms of Bloom's Taxonomy of Educational Objectives, from the "lower order" to the "higher order". Lower order skills would involve for instance being able to use an online catalog to find a book in an academic library. Higher order skills would involve critically evaluating and synthesizing information from multiple sources into a coherent interpretation or argument.

[edit] K-12 education restructuring
Educational reform and restructuring make information literacy skills a necessity as students seek to construct their own knowledge and create their own understandings.
Educators are selecting various forms of resource-based learning (authentic learning, problem-based learning and work-based learning) to help students focus on the process and to help students learn from the content. Information literacy skills are necessary components of each.
The process approach to education is requiring new forms of student assessment. Students demonstrate their skills, assess their own learning, and evaluate the processes by which this learning has been achieved by preparing portfolios, learning and research logs, and using rubrics.
Much of this challenge is now being informed by the American Association of School Librarians that published new standards for student learning in 2007.

[edit] Efforts in K-12 education
Information literacy efforts are underway on individual, local, and regional bases.
Imaginative Web based information literacy tutorials are being created and integrated with curriculum areas, or being used for staff development purposes.
Library media programs are fostering information literacy by integrating the presentation of information literacy skills with curriculum at all grade levels.
Information literacy efforts are not being limited to the library field, but are also being employed by regional educational consortia.
Parents are encouraging their children to develop information literacy skills at home by contacting KidsConnect, the Internet help and referral service for K-12 students. Parents are also helping students work through the information problem solving process as they assist their children with their homework!

[edit] Efforts in higher education
The inclusion of information competencies as a graduation requirement is the key that will fully integrate information literacy into the curricula of academic institutions.
Information literacy instruction in higher education can take a variety of forms: stand-alone courses or classes, online tutorials, workbooks, course-related instruction, or course-integrated instruction.
State-wide university systems and individual colleges and universities are undertaking strategic planning to determine information competencies, to incorporate instruction in information competence throughout the curriculum and to add information competence as a graduation requirement for students. Librarians often are required to teach the concepts of information literacy during "one shot" classroom lectures. There are also credit courses offered by academic librarians to prepare college students to become information literate.
Academic library programs are preparing faculty to facilitate their students' mastery of information literacy skills so that the faculty can in turn provide information literacy learning experiences for the students enrolled in their classes.

Information Technology is the great enabler. It provides, for those who have access to it, an extension of their powers of perception, comprehension, analysis, thought, concentration, and articulation through a range of activities that include: writing, visual images, mathematics, music, physical movement, sensing the environment, simulation, and communication (Carpenter, 1989, p. 2).
Technology, in all of its various forms, offers users the tools to access, manipulate, transform, evaluate, use, and present information.
Technology in schools includes computers, televisions, video cameras, video editing equipment, and TV studios.
Two approaches to technology in K-12 schools are technology as the object of instruction approach, and technology as the tool of instruction approach.
Schools are starting to incorporate technology skills instruction in the context of information literacy skills. This is called technology information literacy
Technology is changing the way higher education institutions are offering instruction. The use of the Internet is being taught in the contexts of subject area curricula and the overall information literacy process.
There is some empirical indication that students who use technology as a tool may become better at managing information, communicating, and presenting ideas.

Now that information literacy has become a part of the core curriculum at many post-secondary institutions, it is incumbent upon the library community to be able to provide information literacy instruction in a variety of formats, including online learning and distance education. The Association of College and Research Libraries (ACRL) addresses this need in its Guidelines for Distance Education Services (2000):
“Library resources and services in institutions of higher education must meet the needs of all their faculty, students, and academic support staff, wherever these individuals are located, whether on a main campus, off campus, in distance education or extended campus programs -- or in the absence of a campus at all, in courses taken for credit or non-credit; in continuing education programs; in courses attended in person or by means of electronic transmission; or any other means of distance education.”
Within the e-learning and distance education worlds, providing effective information literacy programs brings together the challenges of both distance librarianship and instruction. With the prevalence of course management systems such as WebCT and Blackboard, library staff are embedding information literacy training within academic programs and within individual classes themselves (Presti, 2002).

The International Federation of Library Associations and Institutions (IFLA) has established an Information Literacy Section. The Section has, in turn, developed and mounted an Information Literacy Resources Directory, called InfoLit Global. Librarians, educators and information professionals may self-register and upload information-literacy-related materials (IFLA, Information Literacy Section, n.d.)

copyright and fair use


Copyright is a form of intellectual property which gives the creator of an original work of authorship exclusive rights to control its distribution for a certain time period, after which the work is said to enter the public domain. Generally, it is "the right to copy", but usually provides the author with other rights as well, such as the right to be credited for the work, to determine who may adapt the work to other forms, who may perform the work, who may financially benefit from it, and other, related rights. Copyright applies to any expressible form of an idea or information that is substantive and discrete.
Copyright was initially conceived as a way for governments in Europe to restrict printing; the contemporary intent of copyright is to promote the creation of new works by giving authors control of and profit from them.
Copyright has been internationally standardized, lasting between fifty to a hundred years from the author's death, or a finite period for anonymous or corporate authorship; some jurisdictions have required formalities to establishing copyright, most recognize copyright in any completed work, without formal registration. Generally, copyright is enforced as a civil matter, though some jurisdictions do apply criminal sanctions.
Most jurisdictions recognize copyright limitations, allowing "fair" exceptions to the author's exclusivity of copyright, and giving users certain rights. The development of the Internet, digital media, computer network technologies, such as peer-to-peer filesharing, have prompted reinterpretation of these exceptions, introduced new difficulties in enforcing copyright, and inspired additional challenges to copyright law's philosophic basis. Simultaneously, businesses with great economic dependence upon copyright have advocated the extension and expansion of their copy rights, and sought additional legal and technological enforcement.
History

Expansion of U.S. copyright law
Copyright was invented after the advent of the printing press and with wider public literacy. As a legal concept, its origins in Britain were from a reaction to printers' monopolies at the beginning of the eighteenth century. Charles II of England was concerned by the unregulated copying of books and passed the Licensing Act of 1662 by Act of Parliament,[1] which established a register of licensed books and required a copy to be deposited with the Stationer's Company, essentially continuing the licensing of material that had long been in effect.
The British Statute of Anne (1710) further alluded to individual rights of the author, beginning: "Whereas Printers, Booksellers, and other Persons, have of late frequently taken the Liberty of Printing... Books, and other Writings, without the Consent of the Authors... to their very great Detriment, and too often to the Ruin of them and their Families:..."[2] A right to benefit financially from the work is articulated, and court rulings and legislation have recognized a right to control the work, such as ensuring that the integrity of it is preserved. An irrevocable right to be recognized as the work's creator appears in some countries' copyright laws.
The Statute of Anne was the first real copyright act, and gave the publishers rights for a fixed period, after which the copyright expired. Copyright has grown from a legal concept regulating copying rights in the publishing of books and maps to one with a significant effect on nearly every modern industry, covering such items as sound recordings, films, photographs, software, and architectural works.
The Copyright Clause of the United States Constitution (1787) authorized copyright legislation: "To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries." That is, by guaranteeing them a period of time in which they alone could profit from their works, they would be enabled and encouraged to invest the time required to create them, and this would be good for society as a whole. A right to profit from the work has been the philosophical underpinning for much legislation extending the duration of copyright, to the life of the creator and beyond, to his heirs.
The 1886 Berne Convention first established recognition of copyrights among sovereign nations, rather than merely bilaterally. Under the Berne Convention, copyrights for creative works do not have to be asserted or declared, as they are automatically in force at creation: an author need not "register" or "apply for" a copyright in countries adhering to the Berne Convention. As soon as a work is "fixed", that is, written or recorded on some physical medium, its author is automatically entitled to all copyrights in the work, and to any derivative works unless and until the author explicitly disclaims them, or until the copyright expires. The Berne Convention also resulted in foreign authors being treated equivalently to domestic authors, in any country signed onto the Convention. The UK signed the Berne Convention in 1887 but did not implement large parts of it until 100 years later with the passage of the Copyright, Designs and Patents Act of 1988. The USA did not sign the Berne Convention until 1989.
The United States and most Latin American countries instead entered into the Buenos Aires Convention in 1910, which required a copyright notice (such as "all rights reserved") on the work, and permitted signatory nations to limit the duration of copyrights to shorter and renewable terms. The Universal Copyright Convention was drafted in 1952 as another less demanding alternative to the Berne Convention, and ratified by nations such as the Soviet Union and developing nations.
The regulations of the Berne Convention are incorporated into the World Trade Organization's TRIPS agreement (1995), thus giving the Berne Convention effectively near-global application. The 2002 WIPO Copyright Treaty enacted greater restrictions on the use of technology to copy works in the nations that ratified it.

Scope
Copyright may apply to a wide range of creative, intellectual, or artistic forms, or "works". Specifics vary by jurisdiction, but these can include poems, theses, plays, other literary works, movies, dances, musical compositions, audio recordings, paintings, drawings, sculptures, photographs, software, radio and television and broadcasts.
Copyright does not cover ideas and information themselves, only the form or manner in which they are expressed. For example, the copyright to a Mickey Mouse cartoon restricts others from making copies of the cartoon or creating derivative works based on Disney's particular anthropomorphic mouse, but doesn't prohibit the creation of other works about anthropomorphic mice in general, so long as they're different enough to not be judged copies of Disney's. In many jurisdictions, copyright law makes exceptions to these restrictions when the work is copied for the purpose of commentary or other related uses (See Fair Use, Fair Dealing). Meanwhile, other laws may impose additional restrictions that copyright does not — such as trademarks and patents.
Copyright laws are standardized somewhat through international conventions such as the Berne Convention and Universal Copyright Convention. These multilateral treaties have been ratified by nearly all countries, and international organizations such as the European Union or World Trade Organization require their member states to comply with them.

As with patents for physical objects, the granting of a copyright was ensured by governments to promote innovation and guarantee first-to-market protection for the owner of the copyright (historically, more likely the publisher than the creator). This government-sponsored monopoly thus provides innovation and general benefit to society as a whole, but allows for capitalistic pressures after the first-to-market advantage has been provided as a reward (and effort to cover R&D time for such works to be developed).
With the modern emergence of massive mass-media conglomerates however, the first-to-market advantage can be recouped within weeks instead of years. This point is highlighted easily by noting the millions of dollars investment in blockbuster movies are typically recouped within mere days, and the studios themselves even stop collecting ticket sales income after typically one, though sometimes two weeks (which is when local theater owners finally start to collect revenue on ticket sales). Likewise, with the increasing use of technology such as Digital Rights Management to maintain studio control of content the time of monopolistic control of content is extended even beyond that guaranteed by law. This post-copyright restriction planning has come under fire as being disingenuous and even unethical use of the government awarded protection.
The solution to this criticism has been the heavy lobbying by Disney and artist unions to continually extend copyright protections, thus making DRM appear to be protecting copyrights that for all intents are effectively permanent... extending 25 years past the authors/artists death. The most recent extension of this corporate protection was provided by the bill sentimentally named the Sonny Bono Copyright Term Extension Act of 2000, which targeted Senator Bono's artistic heritage and recent death in an appeal to his colleges and the public support for such an act. Copyright lawyers commonly refer to this act as the Mickey Mouse Protection Act due to the hundreds of millions of lobby dollars spent by the Walt Disney Corporation to ensure its passing. Disney's vested interest in this act was due to the pending release of copyright on Steamboat Willie... the first Mickey Mouse cartoon whose success created the mega-cartoon corporation. Releasing Steamboat Willie to the public domain was seen as a slippery slope that Disney executives did not want allowed due to their belief that copyrights should be indefinite.
Another widely debated issue is the relationship between copyrights and other forms of "intellectual property", and material property. Most scholars of copyright agree that it can be called a kind of property, because it involves the exclusion of others from something. But there is disagreement about the extent to which that fact should allow the transportation of other beliefs and intuitions about material possessions. This philosophical difference was highlighted by the Sony vs Disney case regarding record-able CDs and tape. At the time, Disney was attempting to ban VHS-recording machines as illegal devices attempting to impinge on their copyright. The United States Supreme Court disagreed and allowed the sale of VHS recording machines, and in a later, similar suit by Disney the US Supreme Court allowed the sale of recordable CDs and Mini-Discs. This repeated failure to gain government support of their position is what led Disney to try new tactics and lobby for increasing the length of copyright protection and eventually Digital Rights Management.
There are many other philosophical questions that arise in the jurisprudence of copyright. They include such problems as determining when one work is "derived" from another, or deciding when information has been placed in a "tangible" or "material" form.
Some critics claim copyright law protects corporate interests while criminalizing legitimate use. Of particular concern is the increasing mound of orphaned works.
Orphaned works are those that were protected for so long that the original artist is no longer alive, and although the work may now be in the public domain, is no longer available due to physical decay of the paper, film, or physical form due to aging and lack of maintenance. The fact remains that less than 1% of all artistic works created in the United States belong to Disney or other corporations who will maintain their art for commercial gain. The bulk of artistic works do NOT generate any appreciable income after 5 years and due to copyright restrictions provide no motivation for museums, clearing houses, or enthusiast organizations to maintain records of the owner or a copy of the work. These orphaned works may not provide commercial benefit to the artists anymore, however they are fundamental to the fabric of society. As the orphan works disappear, historians lose valuable documents that hold insights into the evolution of phrases, social structure, and even the original source of new forms of art and genres that develop from them. Orphaned works are seen as justifiable losses to modern copyright lobbyists, equating them to an old chair or other form of property that has served its purpose and even if no longer economically viable, the copyright should be maintained in principle. This argument avoids the ethical implications of society losing the very art that it solicited by guaranteeing first-to-market rights.

Obtaining and enforcing copyright
Typically, a work must meet minimal standards of originality in order to qualify for copyright, and the copyright expires after a set period of time (some jurisdictions may allow this to be extended). Different countries impose different tests, although generally the requirements are low; in the United Kingdom there has to be some 'skill, labour and judgment' that has gone into it.[3] In Australia and the United Kingdom it has been held that a single word is insufficient to comprise a copyright work. However, single words or a short string of words can sometimes be registered as a trademark instead.
Copyright law recognises the right of an author based on whether the work actually is an original creation, rather than based on whether it is unique; two authors may own copyright on two substantially identical works, if it is determined that the duplication was coincidental, and neither was copied from the other.
In all countries where the Berne Convention standards apply, copyright is automatic, and need not be obtained through official registration with any government office. Once an idea has been reduced to tangible form, for example by securing it in a fixed medium (such as a drawing, sheet music, photograph, a videotape, or a computer file), the copyright holder is entitled to enforce his or her exclusive rights. However, while registration isn't needed to exercise copyright, in jurisdictions where the laws provide for registration, it serves as prima facie evidence of a valid copyright and enables the copyright holder to seek statutory damages and attorney's fees. (In the USA, registering after an infringement only enables one to receive actual damages and lost profits.)
The original holder of the copyright may be the employer of the author rather than the author himself, if the work is a "work for hire". For example, in English law the Copyright, Designs and Patents Act 1988 provides that if a copyrighted work is made by an employee in the course of that employment, the copyright is automatically owned by the employer as a "Work for Hire."
Copyrights are generally enforced by the holder in a civil law court, but there are also criminal infringement statutes in some jurisdictions. While central registries are kept in some countries, which aid in proving claims of ownership, registering does not necessarily prove ownership, nor does the fact of copying (even without permission) necessarily prove that copyright was infringed. Criminal sanctions are generally aimed at serious counterfeiting activity, but are now becoming more commonplace as copyright collectives such as the RIAA are increasingly targeting the file sharing home Internet user. Thus far, however, most such cases against file sharers have been settled out of court. (See: File sharing and the law)

Copyright notices in the U.S.
Prior to 1989, use of a copyright notice — consisting of the copyright symbol (©, the letter C inside a circle), the abbreviation "Copr.", or the word "Copyright", followed by the year of the first publication of the work and the name of the copyright holder — was part of United States statutory requirements.[4][5] Several years may be noted if the work has gone through substantial revisions. The proper copyright notice for sound recordings of musical or other audio works is a sound recording copyright symbol (℗, the letter P inside a circle), which indicates a sound recording copyright. Similarly, the phrase All rights reserved was once required to assert copyright.
In 1989, the U.S. enacted the Berne Convention Implementation Act, amending the 1976 Copyright Act to conform to most of the provisions of the Berne Convention. As a result, the use of copyright notices has become optional to claim copyright, because the Berne Convention makes copyright automatic.[6] However, the lack of notice of copyright using these marks may have consequences in terms of reduced damages in an infringement lawsuit — using notices of this form may reduce the likelihood of a defense of "innocent infringement" being successful.[7]

"Poor man's copyright"
A widely circulated strategy to avoid the cost of copyright registration is referred to as the "poor man's copyright." It proposes that the creator send the work to himself in a sealed envelope by registered mail, using the postmark to establish the date. This technique has not been recognized in any published opinions of the United States courts. The United States Copyright Office makes clear that the technique is no substitute for actual registration.[8] In fact, in the United States if you do not have a federal registration you are unable to enforce your copyrights.[9] This is because a copyright lawsuit can only be brought in federal court in the U.S. and you may not bring an action without a federally registered copyright. [10] The United Kingdom Intellectual Property Office discusses the technique but does not recommend its use.[11]

Exclusive rights
Several exclusive rights typically attach to the holder of a copyright:
to produce copies or reproductions of the work and to sell those copies (mechanical rights; including, sometimes, electronic copies: distribution rights)
to import or export the work
to create derivative works (works that adapt the original work)
to perform or display the work publicly (performance rights)
to sell or assign these rights to others
to transmit or display by radio or video (broadcasting rights)
The phrase "exclusive right" means that only the copyright holder is free to exercise those rights, and others are prohibited from using the work without the holders permission. Copyright is sometimes called a "negative right", as it serves to prohibit certain people (e.g., readers, viewers, or listeners, and primarily publishers and would be publishers) from doing something they would otherwise be able to do, rather than permitting people (e.g., authors) to do something they would otherwise be unable to do. In this way it is similar to the unregistered design right in English law and European law. The rights of the copyright holder also permit him/her to not use or exploit their copyright, for some or all of the term.
There is, however, a critique that rejects this assertion as being based on a philosophical interpretation of copyright law that is not universally shared. There is also debate on whether copyright should be considered a property right or a moral right.[citation needed] Many argue that copyright does not exist merely to restrict third parties from publishing ideas and information, and that defining copyright purely as a negative right is incompatible with the public policy objective of encouraging authors to create new works and enrich the public domain.[weasel words]
The right to adapt a work means to transform the way in which the work is expressed. Examples include developing a stage play or film script from a novel, translating a short story, and making a new arrangement of a musical work.

This distinction is of critical importance to the near constant wrangling between publishers, other intermediaries, and the original, creative authors.

Copyright law does not restrict the owner of a copy from reselling legitimately obtained copies of copyrighted works, provided that those copies were originally produced by or with the permission of the copyright holder. It is therefore legal, for example, to resell a copyrighted book or CD. In the United States this is known as the first-sale doctrine, and was established by the courts to clarify the legality of reselling books in second-hand bookstores. Some countries may have parallel importation restrictions that allow the copyright holder to control the aftermarket. This may mean for example that a copy of a book that does not infringe copyright in the country where it was printed does infringe copyright in a country into which it is imported for retailing. The first-sale doctrine is known as exhaustion of rights in other countries and is a principle that also applies, though somewhat differently, to patent and trademark rights. It is important to note that the first-sale doctrine permits the transfer of the particular legitimate copy involved. It does not permit making or distributing additional copies.
In addition, copyright, in most cases, does not prohibit one from acts such as modifying, defacing, or destroying his or her own legitimately obtained copy of a copyrighted work, so long as duplication is not involved. However, in countries that implement moral rights, a copyright holder can in some cases successfully prevent the mutilation or destruction of a work that is publicly visible.

Fair use and fair dealing

Copyright does not prohibit all copying or replication. In the United States, the fair use doctrine, codified by the Copyright Act of 1976 as 17 U.S.C. § 107, permits some copying and distribution without permission of the copyright holder or payment to same. The statute does not clearly define fair use, but instead gives four non-exclusive factors to consider in a fair use analysis. Those factors are:
the purpose and character of the use;
the nature of the copyrighted work;
the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
the effect of the use upon the potential market for or value of the copyrighted work.[12]
In the United Kingdom and many other Commonwealth countries, a similar notion of fair dealing was established by the courts or through legislation. The concept is sometimes not well defined; however in Canada, private copying for personal use has been expressly permitted by statute since 1999. In Australia, the fair dealing exceptions under the Copyright Act 1968 (Cth) are a limited set of circumstances under which copyrighted material can be legally copied or adapted without the copyright holder's consent. Fair dealing uses are research and study; review and critique; news reportage and the giving of professional advice (ie legal advice). Under current Australian law it is still a breach of copyright to copy, reproduce or adapt copyright material for personal or private use without permission from the copyright owner. Other technical exemptions from infringement may also apply, such as the temporary reproduction of a work in machine readable form for a computer.
In the United States the AHRA (Audio Home Recording Act Codified in Section 10, 1992) prohibits action against consumers making noncommercial recordings of music, in return for royalties on both media and devices plus mandatory copy-control mechanisms on recorders.
Section 1008. Prohibition on certain infringement actions
No action may be brought under this title alleging infringement of copyright based on the manufacture, importation, or distribution of a digital audio recording device, a digital audio recording medium, an analog recording device, or an analog recording medium, or based on the noncommercial use by a consumer of such a device or medium for making digital musical recordings or analog musical recordings.
Later acts amended US Copyright law so that for certain purposes making 10 copies or more is construed to be commercial, but there is no general rule permitting such copying. Indeed making one complete copy of a work, or in many cases using a portion of it, for commercial purposes will not be considered fair use. The Digital Millennium Copyright Act prohibits the manufacture, importation, or distribution of devices whose intended use, or only significant commercial use, is to bypass an access or copy control put in place by a copyright owner. An appellate court has held that fair use is not a defense to engaging in such distribution.
Educational use is regarded as "fair use" in most jurisdictions, but the restrictions vary wildly from nation to nation.[13]

Transfer and licensing
A copyright, or aspects of it, may be assigned or transferred from one party to another. For example, a musician who records an album will often sign an agreement with a record company in which the musician agrees to transfer all copyright in the recordings in exchange for royalties and other considerations. The creator (and original copyright holder) benefits, or expects to, from production and marketing capabilities far beyond those of the author. In the digital age of music, music may be copied and distributed at minimal cost through the Internet, however the record industry attempts to provide promotion and marketing for the artist and his or her work so it can reach a much larger audience. A copyright holder need not transfer all rights completely, though many publishers will insist. Some of the rights may be transferred, or else the copyright holder may grant another party a non-exclusive license to copy and/or distribute the work in a particular region or for a specified period of time. A transfer or licence may have to meet particular formal requirements in order to be effective; see section 239 of the Australia Copyright Act 1968 (Cth). Under Australian law, it is not enough to pay for a work to be created in order to also own the copyright. The copyright itself must be expressly transferred in writing.
Under the U.S. Copyright Act, a transfer of ownership in copyright must be memorialized in a writing signed by the transferor. For that purpose, ownership in copyright includes exclusive licenses of rights. Thus exclusive licenses, to be effective, must be granted in a written instrument signed by the grantor. No special form of transfer or grant is required. A simple document that identifies the work involved and the rights being granted is sufficient. Non-exclusive grants (often called non-exclusive licenses) need not be in writing under U.S. law. They can be oral or even implied by the behavior of the parties. Transfers of copyright ownership, including exclusive licenses, may and should be recorded in the U.S. Copyright Office. (Information on recording transfers is available on the Office's web site.) While recording is not required to make the grant effective, it offers important benefits, much like those obtained by recording a deed in a real estate transaction.
Copyright may also be licensed. Some jurisdictions may provide that certain classes of copyrighted works be made available under a prescribed statutory license (e.g. musical works in the United States used for radio broadcast or performance). This is also called a compulsory license, because under this scheme, anyone who wishes to copy a covered work does not need the permission of the copyright holder, but instead merely files the proper notice and pays a set fee established by statute (or by an agency decision under statutory guidance) for every copy made. Failure to follow the proper procedures would place the copier at risk of an infringement suit. Because of the difficulty of following every individual work, copyright collectives or collecting societies and performing rights organizations (such as ASCAP, BMI, and SESAC) have been formed to collect royalties for hundreds (thousands and more) works at once. Though this market solution bypasses the statutory license, the availability of the statutory fee still helps dictate the price per work collective rights organizations charge, driving it down to what avoidance of procedural hassle would justify.

Similar legal rights
Copyright law covers the creative or artistic expression of an idea. Patent law covers inventions. Trademark law covers distinctive terms, marks, and names that are used in relation to products or services as indicators of origin, as does (in a similar fashion), Trade dress. Registered designs law covers the look or appearance of a manufactured or functional article. Trade secret law covers secret or sensitive knowledge or information.
Although copyright and trademark laws are theoretically distinct, more than one type of them may cover the same item or subject matter. For example, in the case of the Mickey Mouse cartoon, the image and name of Mickey Mouse would be the subject of trademark legislation, while the cartoon itself would be subject to copyright. Titles and character names from books or movies may also be trademarked while the works from which they are drawn may qualify for copyright.
Another point of distinction is that a copyright (and a patent) is generally subject to a statutorily-determined term, whereas a trademark registration may remain in force indefinitely if the trademark is periodically used and renewal fees continue to be duly paid to the relevant jurisdiction's trade marks office or registry. Once the term of a copyright has expired, the formerly copyrighted work enters the public domain and may be freely used or exploited by anyone. Courts in the United States and the United Kingdom have rejected the doctrine of a common law copyright. Public domain works should not be confused with works that are publicly available. Works posted in the internet for example, are publicly available, but are not generally in the public domain. Copying such works may therefore violate the author's copyright.

If a pictorial, graphic or sculptural work is a useful article, it is copyrighted only if its aesthetic features are separable from its utilitarian features. A useful article is an article having an intrinsic utilitarian function that is not merely to portray the appearance of the article or to convey information. They must be separable from the functional aspect to be copyrighted.[14]
There are two primary approaches to the separability issue: physical separability and conceptual separability. Physical separability is the ability to take the aesthetic thing away from the functional thing. Conceptual separability can be found in several different ways. It may be present if the useful article is also shown to be appreciated for its aesthetic appeal or by the design approach, which is the idea that separability is only available if the designer is able to make the aesthetic choices that are unaffected by the functional considerations. A question may also be asked of whether an individual would think of the aesthetic aspects of the work being separate from the functional aspects.
There are several different tests available for conceptual separability. The first, the Primary Use test, asks how is the thing primarily used: art or function? The second, the Marketable as Art test, asks can the article be sold as art, whether functional or not. This test does not have much backing, as almost anything can be sold as art. The third test, Temporal Displacement, asks could an individual conceptualize the article as art without conceptualizing functionality at the same time. Finally, the Denicola test says that copyrightability should ultimately depend on the extent to which the work reflects the artistic expression inhibited by functional consideration. If something came to have a pleasing shape because there were functional considerations, the artistic aspect was constrained by those concerns.

Duration
Copyright subsists for a variety of lengths in different jurisdictions. The length of the term can depend on several factors, including the type of work (e.g. musical composition, novel), whether the work has been published or not, and whether the work was created by an individual or a corporation. In most of the world, the default length of copyright is the life of the author plus either 50 or 70 years. In the United States, the term for most existing works is a fixed number of years after the date of creation or publication. Under most countries' laws, copyrights expire at the end of the calendar year in question.
The length and requirements for copyright duration are subject to change by legislation, and since the early 20th century there have been a number of adjustments made in various countries, which can make determining the duration of a given copyright somewhat difficult. For example, the United States used to require copyrights to be renewed after 28 years to stay in force, and formerly required a copyright notice upon first publication to gain coverage. In Italy and France, there were post-wartime extensions that could increase the term by approximately 6 years in Italy and up to about 14 in France. Many countries have extended the length of their copyright terms (sometimes retroactively). International treaties establish minimum terms for copyrights, but individual countries may enforce longer terms than those.
In the United States, all books and other works published before 1923 have expired copyrights and are in the public domain. In addition, works published before 1964 that did not have their copyrights renewed 28 years after first publication year also are in the public domain, except that books originally published outside the US by non-Americans are exempt from this requirement, if they are still under copyright in their home country (see How Can I Tell Whether a Copyright Was Renewed for more details).
But if the intended exploitation of the work includes publication (or distribution of derivative work, such as a film based on a book protected by copyright) outside the U.S., the terms of copyright around the world must be considered. If the author has been dead more than 70 years, the work is in the public domain in most, but not all, countries. Some works are covered by copyright in Spain for 80 years after the author's death.
In 1998 the length of a copyright in the United States was increased by 20 years under the The Copyright Term Extension Act. This legislation was strongly promoted by corporations that had valuable copyrights that otherwise would have expired, and has been the subject of substantial criticism on this point.
As a curiosity, the famous work Peter Pan, or The Boy Who Wouldn't Grow Up has a complex – and disputed – story of copyright expiry.

Typefaces
In the United States, the Copyright Office maintains that typeface designs are not covered by copyright, and it will not accept applications for their registration. See 37. C.F.R. § 202.1(e). In Tufenkian Import/Export Ventures, Inc. v. Einstein Moomjy, Inc., 338 F.3d 127, 132 (2nd Cir. 2003),[15] the United States Court of Appeals for the Second Circuit recognized this rule when it held, “the public domain includes, for example, both the generic shape of the letter 'L' and all of the elaborately more specific 'L's' from the hundreds of years of font designs that have fallen into the public domain.” However, if a design is novel and "non-obvious," it may be covered by design patent. See, for example, U.S. Des. Patent No. 289,773 , May 12, 1987), Charles A. Bigelow and Kris A. Holmes, inventors. Germany (in 1981) passed a special extension (Schriftzeichengesetz) to the design patent law (Geschmacksmustergesetz) for protecting them. This permits typefaces being registered as designs in Germany, too. So far, the United States courts have not published any opinions discussing whether a computer program creating a particular font might be intellectual property protected by the copyright laws.
England recognized copyright in typeface at least as early as 1916.[16] The current United Kingdom copyright statute, enacted in 1989, expressly refers to copyrights in typeface designs.[17] The British law also applies to designs produced before 1989.

It is legal in several countries including the United Kingdom and the United States to produce alternative versions (for example, in large print or braille) of a copyrighted work to provide improved access to a work for blind and visually impaired persons without permission from the copyright holder.

The Anti-Counterfeiting Trade Agreement (ACTA) is a proposed plurilateral trade agreement that would impose strict enforcement of intellectual property rights related to Internet activity and trade in information-based goods. The agreement is being secretly negotiated by the governments of the United States, Japan, Switzerland, Australia, New Zealand, South Korea, Canada, and Mexico, and the European Commission.[20][21] If adopted the treaty would establish an international coalition against copyright infringement, imposing strong, top-down enforcement of copyright laws in developed nations. The proposed agreement would allow border officials to search laptop's, MP3 players, and cellular phones for copyright-infringing content. It would also impose new cooperation requirements upon Internet service providers (ISPs), including perfunctory disclosure of customer information, and restrict the use of online privacy tools. The proposal specifies a plan to encourage developing nations to accept the legal regime, as well.

Knowledge Management (KM)


Knowledge Management (KM) comprises a range of practices used in an organisation to identify, create, represent, distribute and enable adoption of insights and experiences. Such insights and experiences comprise knowledge, either embodied in individuals or embedded in organisational processes or practice. An established discipline since 1995, KM includes courses taught in the fields of business administration, information systems, management, and library and information sciences [1]. More recently, other fields, to include those focused on information and media, computer science, public health, and public policy, also have started contributing to KM research. Many large companies and non-profit organisations have resources dedicated to internal KM efforts, often as a part of their 'Business Strategy', 'Information Technology', or 'Human Resource Management' departments [2]. Several consulting companies also exist that provide strategy and advice regarding KM to these organisations.
KM efforts typically focus on organisational objectives such as improved performance, competitive advantage, innovation, the sharing of lessons learned, and continuous improvement of the organisation. KM efforts overlap with Organisational Learning, and may be distinguished from by a greater focus on the management of knowledge as a strategic asset and a focus on encouraging the exchange of knowledge. KM efforts can help individuals and groups to share valuable organisational insights, to reduce redundant work, to avoid reinventing the wheel per se, to reduce training time for new employees, to retain intellectual capital as employees turnover in an organisation, and to adapt to changing environments and markets [3] [4].
History and research
KM efforts have a long history, to include on-the-job discussions, formal apprenticeship, discussion forums, corporate libraries, professional training and mentoring programs. More recently, with increased use of computers in the second half of the 20th century, specific adaptations of technologies such as knowledge bases, expert systems, knowledge repositories, group decision support systems, and computer supported cooperative work have been introduced to further enhance the such efforts [5][6].
A broad range of thoughts on the KM discipline exists with no unanimous agreement; approaches vary by author and school. As the discipline matures, academic debates have increased regarding both the theory and practice of KM, to include the following perspectives:
Techno-centric with a focus on technology, ideally those that enhance knowledge sharing and creation
Organisational with a focus on how an organisation can be designed to facilitate knowledge processes best
Ecological with a focus on the interaction of people, identity, knowledge, and environmental factors as a complex adaptive system akin to a natural ecosystem
Regardless of the school of thought, core components of KM include People, Processes, Technology (or) Culture, Structure, Technology, depending on the specific perspective [7]. Different KM schools of thought include various lenses through which KM can be viewed and explained, to include:
community of practice [8] [9]
social network analysis [10] [11]
intellectual capital [12] [13]
information theory [14] [15]
complexity science [16] [17]
constructivism [18] [19]

Different frameworks for distinguishing between knowledge exist. One proposed framework for categorising the dimensions of knowledge distinguishes between tacit knowledge and explicit knowledge. Tacit knowledge represents internalised knowledge that an individual may not be consciously aware of how he or she accomplishes particular tasks. At the opposite end of the spectrum, explicit knowledge represents knowledge that the individual holds consciously in mental focus, in a form that can easily be communicated to others.[20] [21]
Early research suggested that a successful KM effort needs to convert internalised tacit knowledge into explicit knowledge in order to share it, but the same effort must also permit individuals to internalise and make personally meaningful any codified knowledge retrieved from the KM effort. Subsequent research into KM suggested that a distinction between tacit knowledge and explicit knowledge represented an oversimplification and that the notion of explicit knowledge is self-contradictory. Specifically, for knowledge to be made explicit, it must be translated into information (i.e., symbols outside of our heads).[22]
A second proposed framework for categorising the dimensions of knowledge distinguishes between embedded knowledge of a system outside of a human individual (e.g., an information system may have knowledge embedded into its design) and embodied knowledge representing a learned capability of a human body’s nervous and endocrine systems [23].
A third proposed framework for categorising the dimensions of knowledge distinguishes between the exploratory creation of "new knowledge" (i.e., innovation) vs. the transfer or exploitation of "established knowledge" within a group, organisation, or community. Collaborative environments such as communities of practice or the use of social computing tools can be used for both knowledge creation and transfer [24].

[edit] Strategies
Knowledge may be accessed at three stages: before, during, or after KM-related activities. Different organisations have tried various knowledge capture incentives, including making content submission mandatory and incorporating rewards into performance measurement plans. Considerable controversy exists over whether incentives work or not in this field and no consensus has emerged.
One strategy to KM involves actively managing knowledge. In such an instance, individuals strive to explicitly encode their knowledge into a shared knowledge repository, such as a database, as well as retrieving knowledge they need that other individuals have provided to the repository [25].
Another strategy to KM involves individuals making knowledge requests of experts associated with a particular subject on an ad hoc basis. In such an instance, expert individual(s) can provide their insights to the particular person or people needing this [26].

A number of claims exist as to the motivations leading organisations to undertake a KM effort [27] [28]. Typical considerations driving a KM effort include:
Making available increased knowledge content in the development and provision of products and services
Achieving shorter new product development cycles
Facilitating and managing innovation and organisational learning
Leveraging the expertise of people across the organisation
Increasing network connectivity between internal and external individuals
Managing business environments and allowing employees to obtain relevant insights and ideas appropriate to their work
Solving intractable or wicked problems
Managing intellectual capital and intellectual assets in the workforce (such as the expertise and know-how possessed by key individuals)
Debate exists whether KM is more than a passing fad, though increasing amount of research in this field may hopefully help to answer this question, as well as create consensus on what elements of KM help determine the success or failure of such efforts [29] [30].

[edit] Technologies
Early KM technologies included online corporate yellow pages as expertise locators and document management systems. Combined with the early development of collaborative technologies (in particular Lotus Notes), KM technologies expanded in the mid-1990s. Subsequent KM efforts leveraged semantic technologies for search and retrieval and the development of e-learning tools for communities of practice [31] [32].
More recently, development of social computing tools (such as blogs and wikis) have allowed more unstructured, self-governing or ecosystem approaches to the transfer, capture and creation of knowledge, including the development of new forms of communities, networks, or matrixed organisations. However such tools for the most part are still based on text and code, and thus represent explicit knowledge transfer. These tools face challenges in distilling meaningful re-usable knowledge and ensuring that their content is transmissible through diverse channels [33] [34].
